Our Service

Local Buyer LLC offers U.S. consumers access to federal and state home improvement incentives, financial programs, savings calculators, and a network of local home buyers (the “Service” or “Neighborhood Alerts”). To participate, you must provide certain details about yourself and your property—such as location and home details —which LB uses to deliver custom neighborhood alerts. Information is sent via email and SMS, with a maximum of ten (10) SMS messages and ten (10) emails per month. Standard message and data rates may apply. By opting into the Service, you consent to be contacted by LB via email and SMS. Carriers are not responsible for delayed or undelivered messages.

Not Professional Advisors

Financial decisions, particularly those involving the sale of your home, warrant careful consideration. LB and its representatives, including agents, employees, officers, subsidiaries, members, or partners, do not advocate for any specific decisions via this website or any other means without first advising you to seek professional guidance. All opt out requests will be processed within a reasonable timeline and within federal, state, and local regulations.

We do not guarantee the successful delivery of email messages, or SMS messages by your wireless provider. Messages sent by SMS may not be delivered if the mobile device is not in range of a transmission site, or if the network is down. Factors such as the terrain, how close you are to buildings, foliage, weather, and your equipment may affect the delivery of SMS messages. We will not be liable for losses or damages that come from:

• a message that goes to the wrong number; or
• inaccurate or incomplete content in a text message.

ARBITRATION, CLASS ACTION WAIVER, JURY WAIVER

Please carefully read the following paragraphs as they outline the agreement between you and LB to resolve all disputes through binding individual arbitration.

• Applicability of Arbitration Agreement: You and LB agree that all claims and disputes, including contractual, tort, or statutory claims related to these Terms or the use of the Services, will be resolved by binding arbitration on an individual basis. However, disputes involving equitable relief for alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents are exempted from arbitration. This agreement covers claims that arose before the effective date of these Terms.
• Arbitration Rules: Arbitration will be governed by the Federal Arbitration Act, with ADR Services, Inc. serving as the arbitration provider. If ADR Services is unavailable, an alternative forum will be selected. The arbitration will take place in Los Angeles, CA, and the arbitral forum's rules will apply. Non-appearance-based arbitration may be utilized for claims under USD 10,000.
• Additional Rules for Non-appearance Arbitration: Non-appearance arbitration may be conducted via telephone, online, written submissions, or a combination thereof, chosen by the initiating party.
• Fees: ADR Services' fee schedule applies, with LB covering arbitration costs if it initiates the arbitration. If you initiate arbitration, you will pay the first $100 of the initial filing fee, while LB will cover the remainder and both parties' administrative fees.
• Authority of the Arbitrator: The arbitrator has jurisdiction to decide disputes and grant relief as per law and the Terms. The decision is final and binding.
• Waiver of Jury Trial: Both parties waive the right to a trial by jury and agree to resolve disputes through arbitration.
• Waiver of Class or Consolidated Actions: All disputes must be arbitrated or litigated individually, and class or consolidated actions are not permitted. Disputes regarding the validity of this waiver may be resolved by a court.
• Right to Waive: The rights and limitations in this Arbitration Agreement may be waived by the party against whom the claim is asserted.
• Opt-out: You have the option to opt out of this Arbitration Agreement within 30 days of becoming subject to it. To opt out, notify LB in writing.
• Small Claims Court: Either party may bring an individual action in small claims court.
• Arbitration Agreement Survival: This Arbitration Agreement remains in effect after the termination of your relationship with LB.
